The court said Wednesday that they found an agreement with a previous prosecutor that prevented him from being charged in the case.

The disgraced actor has served more than two years of a three- to 10-year sentence at a state prison near Philadelphia. He had vowed to serve all 10 years rather than acknowledge any remorse over the 2004 encounter with accuser Andrea Constand.

Cosby, 83, who was once beloved as "America's Dad," was convicted of drugging and molesting the Temple University employee at his suburban estate.

The former "Cosby Show" star was charged in late 2015, when a prosecutor armed with newly unsealed evidence — Cosby's damaging deposition from her lawsuit — ordered his arrest just days before the 12-year statute of limitations expired.

It was not a technicality. Regardless of how you feel about Cosby's actions his rights were violated when the state reneged on it's deal to not criminally prosecute in exchange for Cosby's testimony in the civil lawsuit, in which he paid 3.38 million in damages to Andrea Constand....Had the civil trial prosecutor not made that deal, Cosby would have invoked his 5th amendment rights to not self incriminate and he would not have taken the stand...The civil prosecutor knew damn well that without Cosby's testimony, Constands case was not strong enough to get a decision against Cosby....That in itself smells of something wrong.

State prosecutors cannot be allowed to engage in coercive bait and switch tactics which was obviously the case in Cosby's criminal conviction. The state prosecutor in the criminal case was an ambulance chasing, political motivated, pos, democrat looking to take advantage of the bullshit "me too" movement and totally disregarded the previous deal not to prosecute. He violated an offical agreement and in turn violated Cosby's rights. The state of Pennsylvania is entirely to blame for this idiocy and thankfully their Supreme Court FINALLY did their job and lived up to the rule of law....Which has been a rare thing this past year.
