Supreme Court Hears Arguments in Case over Trump’s Birthright Citizenship Order

   The Supreme Court is hearing its first set of Trump-related arguments in the second Trump presidency. The case stems from the executive order President Donald Trump issued on his first day in office that would deny citizenship to children born on U.S. soil to parents who are in the country illegally or temporarily. The executive order marks a major change to the provision of the 14th Amendment that grants citizenship to people born in the United States, with just a couple of exceptions.

   Immigrants, rights groups and states sued almost immediately to challenge the executive order. Federal judges have uniformly cast doubt on Trump's reading of the Citizenship Clause. Three judges have blocked the order from taking effect anywhere in the U.S., including U.S. District Judge John Coughenour. "I've been on the bench for over four decades. I can't remember another case where the question presented was as clear as this one is. This is a blatantly unconstitutional order," Coughenour said at a hearing in his Seattle courtroom.

   The Supreme Court is taking up emergency appeals filed by the Trump administration asking to be able to enforce the executive order in most of the country, at least while lawsuits over the order proceed. The constitutionality of the order is not before the court just yet. Instead, the justices are looking at potentially limiting the authority of individual judges to issue rulings that apply throughout the United States. These are known as nationwide, or universal, injunctions.

The 14th Amendment states -

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

So the key here is "subject to the jurisdiction thereof". Just offhand I would interpret this as saying 'has to obey the law'. Well anybody in any country has to obey the local law whether they're there legally or not so why would the founders specifically state that?

Also, is there anyone in the country that doesn't have to obey the law? Asides from politicians of course... but if politicians aren't subject to the jurisdiction thereof that would mean they wouldn't be citizens either...

Man I'm glad I'm not the one that has to figure all this out.

In my mind this is simple

the constitution makes reference to any person born in the US as being a legal citizen. I don't think that is where the challenge should lie as the verbiage is quite clear and unambiguous

the problem really is about the parents who cam here with intent to drop an anchor baby for the purposes of slidi9ng them into citizenship by virtue of their baby

that should not be the case. the constitution offers no such provision for the parents either implicitly or explicitly and should be interpreted as it is written. The child is a citizen and can stay. the parents are not and have to go.  If this happens to be a situation where the child is a minor and the parents wish to take the child with them then they should be afforded that opportunity and likewise that child should retain the right to re-enter this country as a US citizen throughout the entirety of their life

Yes, in all of their brilliance the founding fathers never anticipated such a calculated misuse of our freedoms .. oh well, no one is perfect -- but until the constitution is amended by an act of congress we have what we have and it is not for any of us to try to take a stab at what or what not the framers were thinking when they wrote that section

they wrote what they wrote and what they wrote is crystal clear. That anchor baby, despite the obviousness of being an anchor baby, is a US citizen and should be afforded all of the rights and provisions of a US citizen.
