Eagle Spirit chairman Calvin Helin, a lawyer and member of the Lax Kw'alaams tribe near Prince Rupert, said as much as $1 million will be needed to fund the lawsuit, which he said could go as far as Canada's Supreme Court.



"First Nations are completely opposed to government policy being made by foreigners when it impacts their ability to help out their own people," Helin said in an interview. "The energy industry is critical to Canada's economy, and by some reports we are losing $50 million a day," because of discounts on Canadian oil due primarily to lack of pipelines to export markets.



"From the indigenous point of view, they have constitutionally protected rights and they are sick and tired of being dependent on the government and want to be able to move their communities forward with non-transfer payment funding. This is one of the biggest projects in the history of their communities that would deliver more benefits in terms of employment, business opportunities and revenues, and cannot be duplicated from government programs they are seeking to escape."

The Eagle Spirit project would be twice the size of the Northern Gateway project, transporting as much as one million barrels a day, and has secured support from First Nations from Bruderheim, Alta., through Northern B.C., to Grassy Point, B.C.



It's modeled after the Alyeska pipeline between Alaska's Prudhoe Bay and Valdez, built and operated with involvement from the state's Indigenous people.



It involves a pre-approved energy corridor that could also accommodate natural gas, power transmission and fibre optic lines.

A First Nations' led $17-billion project to build an oil pipeline from Alberta to the West Coast has put in motion a back-up plan to site its terminal across the border in Alaska to get around an imminent oil tanker ban in British Columbia's northern coast.



Vancouver-based Eagle Spirit Energy Holdings Ltd. has signed a memorandum of understanding with Roanan Corp., a private landowner in Hyder, an old gold-rush town on the Alaska side of the Canada/U.S. border at the head of the Portland Canal, to locate the pipeline's endpoint.



That's where tankers could load Canadian oil and sail through the disputed waters of Dixon Entrance, claimed by both Canada and the United States, if Prime Minister Justin Trudeau's tanker ban becomes law, project chairman and president Calvin Helin said in an interview.



"It's a complete answer to the tanker ban," said Helin, a member of the Lax Kw'alaams band near Prince Rupert who believes Alaska would welcome the proposal because of its significant economic benefits.



It's the project's latest salvo against the controversial ban. Indigenous leaders behind Eagle Spirit say the ban is the result of a lobbying campaign by American-financed environmental NGOs and is being pushed through without their consultation and consent. If adopted, it would eliminate  immediate and future opportunities for development, they say.



The Eagle Spirit project would transport as much as one million barrels a day of Alberta oil to Asia. More than 30 First Nations from Bruderheim, Alta., through Northern B.C., to Grassy Point, B.C. support the project and would be equity owners. In addition to an oil pipeline, Eagle Spirit involves a pre-approved energy corridor that could accommodate natural gas, power transmission and fibre optic lines.



Under its current plan, the pipeline's endpoint and tanker terminal would be located in Grassy Point. If the ban, which is now before Parliament, is implemented, it would effectively prevent the establishment of an oil tanker port in Canadian territory on the Northern B.C. coast, Helin said. The project would then end in the corridor in Hyder, located about 25 kilometres up the coast in Alaska.

The best option would be to build the terminal on the Canadian  side. But, if Trideau continues to sell out Canadian workers and trample Native rights with this foereign funded tanker moratorium, the final point will be twenty five kilometres away in Alaska.

I know if Alberta heavy crude is partially upgraded it can get a higher price when it's exported..



But, is there enough capacity in the Edmonton area to upgrade that much oil to light sweet crude?



I know they've added capacity and more will come on line, but I don't know if it's enough for one million additional barrels per day.

As protesters in British Columbia's Lower Mainland go berserk over tankers from the federally approved Kinder Morgan Trans Mountain expansion, First Nations in the Northern Coast are suing governments for banning them.



The Lax Kw'alaams Indian Band says it filed a civil claim in the Supreme Court of British Columbia Thursday against the federal and provincial governments. It seeks to declare Prime Minister Justin Trudeau's tanker ban "an unjustified infringement on the plaintiffs' aboriginal rights and title."



It also knocks British Columbia's establishment of the Great Bear Rainforest, which the ban aims to protect, but which the band disputes because it says it was implemented in its traditional lands without its consent.
