The U.S. Supreme Court will take up a Jan. 6 defendant's appeal of the Department of Justice's novel use of evidence-tampering law to prosecute hundreds of defendants for obstruction of Congress.

A miscellaneous order released by the high court on Dec. 13 granted the petition of Joseph Wayne Fischer, challenging the most widely charged felony in Jan. 6 cases, which carries up to 20 years in prison.

The Fischer case is one of three identical petitions for case review by Jan. 6 defendants who were charged with corruptly obstructing an official proceeding, namely a joint session of Congress convened for the counting and certification of Electoral College votes on Jan. 6, 2021.

They can at least partially thank Jamal Bowman's stunt with the fire alarm for complicating the definition of "obstructing an official proceeding". The moment they declined to throw the book at him they cut the legs out from under their own prosecutions of January 6th protestors using that statute.

I was cautiously optimistic they'd toss Bowman under the bus for that very reason but as it turned out the impulse to protect each other from any real accountability was stronger than bolstering their flimsy persecutions prosecutions of the protestors.

Ah well. Maybe next time?
Rest assured there will be a next time; their towering hubris and utter stupidity will see to that. If the genocide in Gaza hadn't united and distracted both establishment wings of the uniparty someone would have no doubt shown his or her ass again already.

According to a Monmouth University national poll of adults that indicates only 6% approve of the job the long-serving lawmaker has been doing compared to a whopping 60% who disapprove and 34% with no opinion.

McConnell even faces a wall of disapproval on the political right: the poll found that among self-reported Republicans, 10% approve of the job he's doing versus 41% who disapprove and 49% with no opinion.

McConnell, who has been serving as a U.S. senator since 1985 and has described himself as a "Reagan Republican," suffered two bizarre freezing episodes that were caught on camera earlier this year. His current term does not end until early 2027.
