there are a lot of blacks out there, not all certainly, maybe not even half, but a lot who won't convict one of their own.  We saw that with the OJ trial, and with Eric Holder, Obama's Attorney general, who refused to prosecute black panthers who were intimidating people at polling places.



I guarantee if a white guy had faked a hate crime, and framed blacks for it, and was let off, black people would be rioting in Chicago right now.

Wazzer may correct me, but it is my understanding that these people are elected. That creates a problem from the start, and is guaranteed to introduce bias and prejudice into the system. It also precludes those who abuse their position from being removed by the government.



From a distance, this incident represents a tipping point in US judicial appointments and racial prejudice.

Appointments are accountable to the government which is accountable to ALL the population.



Even political appointments are frequently questioned and challenged. Importantly, at least here in Oz, government appointments are on a contract basis and can be cancelled as they often are if the appointee is found to be performing poorly.

The Chicago police department has called for her to be investigated (they have called for her to be investigated before, but nothing came of it) many of the cops, including the black police chief, are furious.  Radical leftist blacks like her are usually very anti-police.  It looks like soro's and Obama's scheme to racialize the justice system has worked.

Johnson condemned Smollett, 36, for his role in allegedly orchestrating a fake hate crime despite the fact that charges against the actor were dropped.



" ... Three things I'd like to say," he continued. "One: on financial cost, this $10,000 doesn't even come close to what the city spent in resources to actually look over the camera, gather all the data, gather all the information that actually brought the indictment by the grand jury, on many, many multiple different charges."



He continued:



The ethical costs is: as a person who is in the House of Representatives when we tried to pass the Shepard legislation that dealt with hate crimes putting them on the books, that President Obama then signed them into law, to then use those very laws and the principles and values behind the Matthew Shepard hate crimes legislation to self-promote your career is a cost that comes to all the individuals, gay men and women who will come forward and one day say they were the victim of a hate crime will now be doubted.



He used the laws of the hate crime legislation that all of us, collectively, over years, have put on the books to stand up to be the values that embody what we believe in. This is a whitewash of justice," Emanuel said.



"A grand jury could not have been clearer. To then say not only is the cost of $10,000 doesn't come close financially but all the other repercussions of this decision it made, to me, where is the accountability in the system? You cannot have, because of a person's position, one set of rules apply to them and another set of rules apply to everybody else," he concluded.



Johnson also spoke at the press conference and he stood by the investigation. He also expressed his frustration over the charges getting dropped.



"If you want to say you're innocent of a situation, then you take your day in court. I would never — if someone falsely accused me, I would never hide behind a brokered deal in secrecy, period," Johnson said during the press conference.

That's why the police want her investigated.  She said she recused herself, but she did not truly recuse herself, she only unofficially did it, not in a legal sense.  Also it was her underling who was in charge of the case, not someone independent.

Actually there is no charge for faking a hate crime. That should be against the law, but unbelievably it is not.  He was charged with lying on a police report.



Sending the letter violates mail fraud laws, and the sentence is up ten years in prison.  But I have not heard of any action on that front.  As another possible punishment--The mayor of Chicago said something about suing Smollett for the costs of the investigation.

To date, the nature of the purported emergency has not been publicly disclosed. The sealing of a court case immediately following a hearing where there was no reasonable notice or opportunity for the public to attend is a matter of grave public concern and undermines the very foundation of our public court system.



Lastly, the State's Attorney has claimed this arrangement is "available to all defendants" and "not a new or unusual practice." There has even been an implication it was done in accordance with a statutory diversion program. These statements are plainly misleading and inaccurate. This action was highly unusual, not a statutory diversion program, and not in accordance with well accepted practices of State's Attorney initiated diversionary programs. The IPBA supports diversion programs, and recognizes the many benefits they provide to the community, the defendant and to the prosecuting agency. Central to any diversion program, however, is that the defendant must accept responsibility. To be clear here, this simply was not a deferred prosecution.



Prosecutors must be held to the highest standard of legal ethics in the pursuit of justice. The actions of the Cook County State's Attorney have fallen woefully short of this expectation. Through the repeated misleading and deceptive statements to the public on Illinois law and circumstances surrounding the Smollett dismissal, the State's Attorney has failed in her most fundamental ethical obligations to the public. The IPBA condemns these actions.

Latest Jussie Smollett News: CHICAGO -- The two brothers who Chicago police said were involved in an allegedly staged attack on "Empire" actor Jussie Smollett have filed a federal defamation lawsuit against his attorneys.



Attorneys for Ola and Bola Osundairo held a news conference Tuesday morning to discuss the lawsuit, which has been filed against Smollett's attorneys Mark Geragos and Tina Glandian, and the Geragos & Geragos Law Firm.



"Attorneys Mark Geragos and Tina Glandian, through their continued false statements and hateful rhetoric, have only deepened the damage that was cause by the very first out of 16 counts of lies that were told to the police that started this whole situation," said Gloria Schmidt, attorney for the Osundairo brothers.



"My city, my police department and my clients deserve to have their reputations restored," Schmid added.



The lawsuit alleges that, "Smollett directed every aspect of the attack, including the location and the noose" and that his attorneys defamed the brothers in statements to the media.



"There are numerous defamatory statements and they are all included in the 16-page lawsuit that we filed," said James Tunick, attorney for the Osundairo brothers.



The lawsuit says that due to the attention and the negative comments from Smollett's attorneys, they haven't been able to work and it is affecting their livelihood. They are suing Geragos and Glandian for $75,000 each.[/quote]

He has not been acquitted. The prosecutor simply declined to pursue judgment. That is not an exoneration in other jurisdictions.

Crimes are generally divided into 2 classes; felonies and misdemeanors - one being for serious criminal acts that are typically dealt with by a higher court (judge and jury) and the other for lesser offences heard before a single judge or magistrate. Felonies are sometimes referred to as indictable offences, and misdemeanors as simple offences.



Your terminology may differ, but the categorisation of criminal acts is the basis of most western jurisdictions, in order to determine which court conducts the hearings and trials.

I would suggest that it's because winning is everything and the means (or even legality) is of no concern to them

I've heard of it, but then I looked at my phone and realized I was not in Alabama and it is not 1921.
