Supreme Court of Canada Sides with Victims of Cyberbullying

After 15 year old A.B. was the victim of a degrading Facebook bullying incident, she did what we hope all teens would do in this type of situation. She sought justice.
Facebook counsel provided the IP address (computer address) of the person who had set up the fake profile, and the Internet service provider that could reveal the identity of the person associated with that IP. The service provider said it would release the name – provided A.B. could present it with a court order.
When she arrived in court seeking such an order, however, she was told by the trial judge that she had to fill in her full name on the draft order before he would grant it. He denied her request to proceed under a pseudonym.
Backed by UNICEF Canada and BullyingCanada Inc. and others, but opposed by Civil Liberties Associations and major media corporations asserting freedom of the press, A.B.'s request for anonymity proceeded all the way up to the Supreme Court of Canada.
In an affirming decision for victims of cyberbullying, the Supreme Court of Canada explicitly recognized the harm that would occur to children if they were too afraid to come forward, and allowed A.B. to proceed anonymously.
