Basically, in the 1990's Congress repealed the Nixon era law allowing an Independent Counsel. Janet Yellin (Clinton's head of DOJ) didn't like that so she ordered an new "special prosecutor" regulations be written up which essentially recreated the Independent Counsel rule but without any legal basis of a law backed by Congress.
The judge found that regulation was just made up without any basis in law passed by Congress and that it was also unconstitutional because it violated the constitution's requirements that powerful officers must be nominated by the president and confirmed by the Senate. Which Jack Smith never was.
