The Supreme Court will hear a case in the next term that could remove a significant amount of power from the federal government.



The case was brought by herring fishermen in New England, challenging the National Marine Fisheries Service's authority to force them to carry a monitor on their vessels who ensures the fishermen comply with federal regulations. Not only do fishermen not have a say in whether monitors are placed on their vessels, but they are forced to pay the monitor's salary.



The industry estimates the regulations reduce their profits by 20%.



The Supreme Court granted a writ of certiorari to answer the following question:



Whether the Court should overrule Chevron or at least clarify that statutory silence concerning controversial powers expressly but narrowly granted elsewhere in the statute does not constitute an ambiguity requiring deference to the agency.

The case, then, could gut the Chevron doctrine, established by the landmark Supreme Court case Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. in 1984.



"In Chevron, the Supreme Court set forth a legal test as to when the court should defer to the agency's answer or interpretation, holding that such judicial deference is appropriate where the agency's answer was not unreasonable, so long as Congress had not spoken directly to the precise issue at question," Cornell Law explains.



In layman's terms, the Chevron Doctrine significantly empowers the federal government because in the absence of explicit statutory language (for which Congress is responsible), the courts defer to the executive branch's "reasonable" statutory interpretation.



Unsurprisingly, those interpretations almost always favor the federal government, because the definition of "reasonable" has been stretched beyond reason.



The potential implications of Loper Bright cannot be ignored because the government stands to lose a significant amount of power. But as law professor Jonathan Adler explained, the Supreme Court is not likely to overrule Chevron altogether.



"t is more likely the Court merely takes the opportunity to narrow the doctrine and make clear that statutory silences and ambiguities should not be construed as grants of agency authority," Alder reacted.



Ironically, the case made it to the Supreme Court because the D.C. Circuit Court of Appeals applied Chevron deference, ruling 2-1 that the government is justified in its interpretation of the Magnuson-Stevens Act. Thus, they ruled that the monitor program, which hamstrings herring fishermen, is legal.



Justice Ketanji Brown Jackson, who served on the D.C. Circuit Court of Appeals until last June, recused herself from the case.

The Biden Department of Justice and the FBI are reportedly in possession of a document that details a possible "criminal scheme"

involving then-Vice President Joe Biden's collusion with a foreign national.



According to a reportedly reputable whistleblower, the document in question allegedly provides specific details about how Biden did the bidding of a foreign national, delivering requested policy decisions in exchange for cash.



House Oversight Committee chairman James Comer (R-Ky.) and Republican Sen. Chuck Grassley (R-Iowa) are now demanding that the FBI produce the record in question, having issued a subpoena to that effect.



The Republican duo penned a letter to FBI Director Christopher Wray and Attorney General Merrick Garland Wednesday, noting that on the basis of "legally protected and highly credible unclassified whistleblower disclosures ... it has come to our attention that the Department of Justice (DOJ) and the Federal Bureau of Investigation (FBI) possess an unclassified FD-1023 form."



An FD-1023 form is a document used by the FBI to record interviews with whistleblowers and other sources.



According to Comer and Grassley, the form contains "valuable, verifiable information" describing "an alleged criminal scheme involving then-Vice President Biden and a foreign national relating to the exchange of money for policy decisions."



In addition to a broad outline of impropriety, the record allegedly "includes a precise description of how the alleged criminal scheme was employed as well as its purpose."

Fox News correspondent Peter Doocy confronted the Biden administration on Tuesday over its claim that illegal immigration has decreased by more than 90%.



The "more than 90%" claim received a lot of attention, but no follow-up at Monday's press briefing. So on Tuesday, Doocy took it upon himself to ask Jean-Pierre exactly from where she derived that figure.



"Where did that number come from?" he asked, noting that Customs and Border Protection says that illegal migration has increased compared to last year.



It's true, according to Fox News correspondent Bill Melugin, that immigration numbers from countries in the parolee program improved — but that improvement was offset by increasing migration from countries not in the program.



"There was a window of time earlier this year where encounters with Venezuelans, Nicaraguans, and Cubans did temporarily dip 90% after a policy change, but other countries, like China, shot up over 800%. Illegal crossings, including Venezuelans, back at peak highs now," Melugin explained.



Indeed, on the same day that Jean-Pierre claimed immigration had improved, the Border Patrol announced that more than 22,000 migrants had been apprehended in the previous 72 hours.







In fact, when Biden announced the parolee program about four months ago, Melugin predicted the Biden administration would use the program control the optics of the border crisis while simultaneously exacerbating it.
