It's satire.  It's formatted as if he's the President.  Larry Flynt has already fought this one.

I'm not sure what the Flynt case was about and how it relates, but if that's fair comment then those are some pretty loose free speech laws. Some people will actually believe that those are his policies. They're literally putting words in his mouth that he never said, which will affect the outcome of the election.

Larry Flynt went head to head with Jerry Fallwell over a Campari ad where Jerry talks about forbicating with his mother in an outhouse.  The test in terms of free speech is if a reasonable person would believe it to be true.  Beyond that, it's a matter of taste and not law.

Aha! There you go: "reasonable people". That's my point. The vast majority are going to believe it to be true! =P



Seriously though, I think the standard should be a bit higher when it can affect the outcome of an election. It's not just someone's feelings that are at stake here. It's potentially the welfare of the whole country.

Editorials are ... well, editorials and are one person's opinion, or even a group of people's opinion. It's not printed as fact, and especially not in this case. It's not libel. IT may be in very poor taste, but hte Boston Globe is not a bastion of objectivity, so what do you expect. The days of newspapers publishing actual news and just news are long gone.

I realize the Globe intended this as satire. But, I wonder if everyone who reads it is able to discern that. If that translates into losing votes he has a case.
