With the Dems unwilling to accept electoral college results under any circumstances, and with a four to four split on the supreme court, a replacement justice must be on the supreme court.

It will not matter. Even if Trump is able to get a nominee confirmed and if a Trump win in November comes down to a SCOTUS decision, it will be seen as a decision from a Trump/conservative stacked court and no democrap will attach legitimacy to the election results. When it comes to the democrats, we are not dealing with a healthy political system and the welfare of the country is on the back burner, regardless of the ridiculous lip service they give to the constitutional process. TDS and partisan politics rule the day on the left.

Marc Short, Vice President Mike Pence's chief of staff, cited "historical precedent" to push back on CNN anchor Jake Tapper during a Sunday morning "State of the Union" debate about the battle over the late Justice Ruth Bader Ginsburg's open Supreme Court seat.



"It's a pretty easy historical precedent," Short responded. "Of those 29 I laid out for you, there are 19 of those vacancies that happened when the majority party was the same party of the president. Of those 19, nine out of 10 were confirmed before election day, and another eight out of nine after election day in the lame duck period, including John Marshall."



"Take the separate scenario in which the party in control in the Senate is a different party than the president," he continued. "There are 10 such vacancies. Only one out of 10 was filled before election day, and you have to go back to the 1880's to find that example under Grover Cleveland's presidency. So actually the historical precedent is pretty clear. When you have a party in power in the Senate whose job it is to advise and consent and confirm the president's nominee, it continually has shown historically that that is the job of the Senate to confirm the president's nomination, and history shows it's the president's obligation to make a nomination."



Short drew a contrast to when the Senate and White House are controlled by opposite parties, noting "those nominations have not moved."



"That's exactly what leader McConnell did in 2016," he said.



"Jake, I reject the notion as hypocrisy," Short replied. "Historical precedent is when your party's in power, and consistently going back to George Washington, the party has continued to confirm those nominees."

Democrats Want to Change the Number of Supreme Court Justices Against Ginsburg's Advice



Republican Senate Conference Chairman John Barrasso (R-Wyo.) supports immediately nominating a Supreme Court justice to replace Justice Ruth Bader-Ginsburg, saying that if Senate Minority Leader Chuck Schumer (D-N.Y.) and Democrats gain control in 2021, they will "change the rules."



The Wyoming senator told Fox News: "If the Democrats win the White House and the Senate and have the House, they will change the rules, they will blow up the Senate, they have an entire war room working on this."



"They will expand the number of members of the Supreme Court, regardless of what the Republicans and President Trump do. ... This is a pure power grab and then they want to stack the Senate as well by expanding the number of states to include DC statehood, with two new Democrat senators," Barrasso added.



When addressing the topic of expanding the number of Supreme Court justices during an NPR interview in 2019, Ginsburg said they shouldn't expand the court as it would make it too political.



"Nine seems to be a good number. It's been that way for a long time," she told NPR. "I have heard that there are some people on the Democratic side who would like to increase the number of judges. I think it was a bad idea when President Franklin Roosevelt tried to pack the court," Ginsburg said.



Ginsburg said she was not in favor of such a change.



"If anything would make the court look partisan," she told NPR. "It would be that—one side saying, 'When we're in power, we're going to enlarge the number of judges, so we would have more people who would vote the way we want them to.'"

Senate Democrats have virtually no chance of stopping Republicans in the chamber from confirming a sixth conservative justice on the nation's highest court before the Nov. 3 election, Senate experts on both sides of the aisle tell The Epoch Times.



There are parliamentary delaying tactics that will slow things temporarily such as quorum calls and repeatedly demanding time-consuming on-the-record votes, but most of the advantages are with the 53 Republicans who control the Senate, as long as they stay united.



Plus, Senate Majority Leader Mitch McConnell (R-Ky.) is considered a master of Senate procedures, a fact that has often frustrated the Senate's 45 Democrats and two independents who typically vote with them.
