A panel of federal judges on Monday upheld a lower court decision that found the Department of Homeland Security unlawfully terminated the Migrant Protection Protocols created by the Trump administration, dubbed the "Remain in Mexico" policy for asylum seekers.

On "The Rubin Report," retired Lt. Col. Allen West, candidate for Texas governor, joined BlazeTV host Dave Rubin to talk about the Biden administration's migrant crisis and the real reason Democrats andradical left want open borders.



"It is nefarious. It's intentional and purposeful," Allen said of the Biden administration's immigration policies. "When I look at this open borders agenda that was implemented — unconstitutionally, I mean you cannot give up the sovereignty of the United States of America by executive order — but then you look at H.R.1 and what H.R.1 talks about, because both of them came at about at the same time. H.R.1 says that there will be no voter registration review, there will be no picture ID, that we will be doing voting by unsolicited mail-in ballots, and online voter registration, same-day voter registration and voting, and illegals being able to vote. And you look at this infrastructure bill, the human infrastructure bill, where they're talking about granting amnesty. And so, by the end of this year we will be looking at close to 2 million illegal immigrants, this is a record high for the United States of America, have crossed the border and come into this country."



Allen also explained why it's not just Biden's immigration policy that is failing, but NGOs as well. He revealed how non-governmental organizations at the U.S. border, like Catholic Charities, are actually making matters worse by enabling crime and human trafficking.

Biden released a statement in which he appeared to give up on passing his massive "Build Back Better" spending bill after the Senate rejected the Democrats' latest attempt to shoehorn immigration reform into the legislation.



Democrats hoped to pass the social spending bill ahead of Christmas in order to celebrate a legislative victory for Biden, but they need and can't get a pivotal vote from Democrat Sen. Joe Manchin of West Virginia.



Further complicating passage was the rejection of their pathway to citizenship for illegal aliens late Thursday.

Joe Manchin drops Christmas bomb on Democrats, says he will not support Biden's Build Back Better Act



Sen. Joe Manchin (D) has officially sinked President Joe Biden's social spending agenda.



The West Virginia Democrat confirmed in an interview on "Fox News Sunday" that he will not — and cannot — vote for Biden's "Build Back Better" plan.



What are the details?

In fact, not only will Manchin not support the massive $1.75 trillion legislative package, but Manchin said he would not continue negotiations moving forward, officially killing the bill.



"I've always said this: If I can't go home and explain it to the people of West Virginia, I can't vote for it. And I cannot vote to continue with this piece of legislation. I just can't," Manchin said. "I've tried everything humanly possible. I can't get there."



"This is a no on this legislation," Manchin added. "I have tried everything I know to do."



Manchin sharply criticized Democrats' vision for America.



"My Democratic colleagues in Washington are determined to dramatically reshape our society in a way that leaves our country even more vulnerable to the threats we face. I cannot take that risk with a staggering debt of more than $29 trillion and inflation taxes that are real and harmful to every hard-working American at the gasoline pumps, grocery stores and utility bills with no end in sight," Manchin explained.



In fact, Manchin said that Democrats are being dishonest about the true cost of the "Build Back Better" bill.



"The American people deserve transparency on the true cost of the Build Back Better Act. The non-partisan Congressional Budget Office determined the cost is upwards of $4.5 trillion which is more than double what the bill's ardent supporters have claimed. They continue to camouflage the real cost of the intent behind this bill," Manchin explained.



Additionally, Manchin said the bill would hinder America's ability to respond to increasing geopolitical threats from Russia and China, "risk the reliability of our electric grid," and "increase our dependence on foreign supply chains."
