Some info on what Smollett might be charged with and the possible penalty-

If Smollett falsified a police report, the charge is a Class 4 felony in Illinois, and carries a potential sentence of one to three years in prison. Smollett could also be ordered to pay restitution to compensate for the cost of the Chicago Police Department investigation.

And then there is of course the note (see above). That could be a federal charge of mail fraud and/or a terrorist hoax.

BTW This is not his first offense--Smollett was convicted of a crime in 2007 and sentenced to 3 years probation.

Smollett pleaded no contest in 2007 to three misdemeanor counts stemming from a DUI incident in Los Angeles, including one count of giving false information to the police. According to the criminal complaint filed by the L.A. City Attorney's office, Smollett gave a false name, pretending to be his brother Jake. He was sentenced to three years of probation.

I don't know how they know that.  Unless perhaps the two brothers he paid told the police that he said that, or it was in some of Smollett's correspondence with them.

According to the New York Times, Smollett's mother and father were a bunch of prog activists.  Smollett grew up around members of the black panther party.  His mother was a big associate of several black panther party members.  That might help to explain why he feels oppressed making $125,000 an episode of Empire.
