Chicago's top prosecutor, Kim Foxx, has been subpoenaed to appear at a hearing over her handling of the Jussie Smollett case, according to a new report.



The Cook County state's attorney was slapped with the subpoena by a retired judge who's pushing for the appointment of a special prosecutor to look into how Foxx dealt with the controversial case, the Chicago Sun-Times reported.



Ex-appellate Judge Sheila O'Brien also subpoenaed Foxx's top deputy Joseph Magats, and filed a document requesting that Smollett appear at the hearing, the report said.

That's encouraging.

I don't know how the judicial process works there...but a declination to prosecute does not exclude charges being laid in the future.

Good point--That's true, although if he is charged again it will have to be within the statute of limitations, which is 1 year for misdemeanors and 3 years for felonies.  The clock is ticking.

We don't have felonies here, but I hope what Smollett did is a felony.

Crimes are generally divided into 2 classes; felonies and misdemeanors - one being for serious criminal acts that are typically dealt with by a higher court (judge and jury) and the other for lesser offences heard before a single judge or magistrate. Felonies are sometimes referred to as indictable offences, and misdemeanors as simple offences.



Your terminology may differ, but the categorisation of criminal acts is the basis of most western jurisdictions, in order to determine which court conducts the hearings and trials.

What Smollett did was serious crime. He cannot be allowed to get away with it.
