New York State, City Sued Over COVID-19 Treatment Order That Discriminates Against Whites



Two men who are fully vaccinated against COVID-19 are suing the city and state of New York for unconstitutional racial discrimination for directing medical providers to consider race in distributing lifesaving treatments.



The lawsuit comes after former U.S. Secretary of Housing and Urban Development Ben Carson ridiculed the city's directive as an example of critical race theory in action.



"I certainly don't think that the virus discriminates," Carson, a retired neurosurgeon, told "The Chris Salcedo Show" last month. "I think it takes everybody. And this is absolute absurdity. We've gone crazy. This is, you know, critical race theory infiltrating everything."



Plaintiffs Jonathan Roberts, 61, and Charles Vavruska, 55, are ineligible for treatments because they are non-Hispanic whites, say their lawyers at Sacramento, California-based Pacific Legal Foundation (PLF), a national public interest law firm.



PLF senior attorney Anastasia Boden said this policy is "part of a growing trend to continuously view the world in terms of race, to not see people as individuals, but solely as members of the groups they're born into, and to dole out benefits and burdens on the basis of immutable characteristics, and that's exactly what the Fourteenth Amendment was intended to prohibit."

Federal agents have arrested a black man in Buffalo, New York, for making a false threat against black people to see whether racists on social media would support him.



According to WIVB-TV in Buffalo, Rolik Walker, 24, of Buffalo, was arrested for a tweet he supposedly published on May 16 from an anonymous account. In the tweet, he reportedly threatened that he and his "associates" would be "targeting" Buffalo-area grocery stores and that they were "only looking to kill blacks."



Walker, who is black, allegedly issued the tweet under the Twitter handle @ConklinHero just two days after white man Payton Gendron, 18, from Conklin, New York, allegedly shot and killed 10 black people and injured three others at a Tops Friendly Markets grocery store in Buffalo. The violent crime has been deemed a "racially motivated hate crime."



An FBI affidavit claims that Walker "stated that the purpose of the post was to see what everyone would say and if anyone would agree with him."



On Thursday, U.S Attorney Trini E. Ross announced that Walker had been arrested and charged with making an interstate threat. The charge carries a sentence of up to five years in prison and a $250,000 fine.

Minneapolis Public Schools and the Minneapolis Federation of Teachers have come to an agreement that will, among other things, protect members of "underrepresented populations" from possible layoffs at the expense of white teachers with more experience.



The two sides came to the agreement back in March to end a two-week strike. According to the Tennessee Star, the agreement contains specific language to protect non-white teachers in the event that the district needs to reduce or relocate teachers within the district.



In a section outlining which "Designated Programs/Staff" may receive an "Exemption from Layoff," the agreement states that certain teachers "may be exempted from district-wide layoff outside of seniority order to remedy the continuing effects of past discrimination." Such teachers include:



Those working at one of the 15 "Racially Isolated Schools with the greatest concentrations of poverty";

"Members of populations underrepresented among licensed teachers in the District"; and

"Alumni of Historically Black Colleges and Universities (HBCU), Tribal Colleges and Universities and/or Hispanic Association of Colleges and Universities (HACU) programs."



Representatives from MFT have celebrated the added protections for members of these groups, particularly "teachers of color."

The judgments stem from the Liberal Arts and Sciences Test, which all NYC teachers and prospective teachers were required to pass in order to receive a teaching license between 1994 and 2014. Between 1993 and 1995, 90% of white teachers and prospective teachers who took the test passed, compared to just 53% of their black counterparts. Hispanic test-takers performed even worse, passing just 50% of the time.
