Federal judge rules Obamacare unconstitutional

A federal judge in Texas said on Friday that the Affordable Care Act's individual coverage mandate is unconstitutional and that the rest of the law therefore cannot stand.



Legal experts say the ruling won't immediately affect Americans' health coverage, and a group of states led by California is already vowing to appeal. But the invalidation of the landmark health care law popularly known as Obamacare throws into doubt the future of health coverage for millions of Americans on the Obamacare exchanges and in Medicaid expansion.

The ruling and expected appeal sets up another cliffhanger in which the fate of the law, which Republicans have unsuccessfully tried to repeal for years, will likely once again ultimately lie with the Supreme Court.

Chief Justice John Roberts cast the deciding vote leaving the law intact in 2012, but it's unclear how the justices will view this challenge, which centers on changes to the individual mandate that were baked into the 2017 tax reform.

I haven't read  the whole ruling yet, but my understanding it's only on the individual mandate.



As a sidebar on Obamacare, premiums skyrocketed 105% between 2013 and 2017 and fifty per cent of counties had only one or no insurer. Since reforms in 2017, premiums have risen five per cent because there is choice now for insurers. The GOP congress stabilized Obamacare. It was unsustainable under Obama.

Tangentially...what is a STATE judge doing ruling on FEDERAL legislation.



State courts have no authority on Federal matters in Australia.

State courts have no authority on Federal matters in Australia.

Apparently they can make rulings, but it doesn't need an appeal to a higher court. Any federal judge can over rule it. And since most judges in the Southern district are prog appointees, I expect that to happen.

That's why nobody in any branch of government is too concerned about coming up with a replacement. A federal judge will over rule the state judge's decision.

It was actually a federal judge making this ruling, not a state judge.  Its confusing because they list Texas.
