I'm not saying that can't happen but it really shouldn't.
The Colorado judgement basically convicted Donny of sedition/insurrection/whatever without a trial in order to reach the decision it did and not even the holy relic of "states' rights" is big enough to cover their asses for that fuckup.

Unless things are even more broken than I presume them to be (and that's all kinds of broken) there's just no way to uphold the Colorado ruling and expect to retain a shred of legitimacy. Maybe the entire SC is beyond caring about legitimacy but if so they're hiding it fairly well so far.

At least, for all of his faults, Roberts can break away from the commonly held conservative consensus when he truly believes it is contrary to the constitution. I can totally respect that. Even when I don't like or agree with it.

I didn't like when Mike Pence refused to ride with Trump's bonehead idea about him having the power to decertify the election and stop an incoming president (which on its face is a fucking ludicrous notion) but I happened to agree with him and never once disparaged him for what he did on that day. He did what he believed was right and it was right and like it or not I can live with that.

What do you expect to happen next and when? Will the Supreme Court here the case quick like they did in 2000 with Biden and Gore and the Florida counting dispute?

I did a search looking for likely outcomes of the Colorado decision. I found this.

A former U.S. Supreme Court law clerk claimed Wednesday that the high court will likely rule against the Colorado Supreme Court decision to bar former President Donald Trump from appearing on the state's 2024 ballots.

Earlier this week, the Colorado high court ruled that the former president is disqualified from being on the ballot in the state because of his role in the Jan. 6, 2021, Capitol breach. The 4–3 ruling, which is based on a reading of a provision in the Constitution's 14th Amendment, is likely to be taken up by the U.S. Supreme Court, some analysts have noted.

The ruling applies only to Colorado's March 5 Republican primary but it could affect President Trump's status in the state for the Nov. 5 general election. Nonpartisan U.S. election forecasters view Colorado as safely Democratic, meaning that President Joe Biden will likely carry the state regardless of President Trump's fate there.

Chris Landau, a former law clerk for U.S. Supreme Court Justices Clarence Thomas and the late Justice Antonin Scalia, said the Colorado ruling is "lawfare" and was one of "the most antidemocratic decisions we have seen in American history—that four unelected judges on a state Supreme Court have taken it upon themselves to disqualify someone who otherwise meets all the qualifications of the Constitution."

Speaking to Fox News this week, Mr. Landau said he is confident that the U.S. high court will overturn the Colorado Supreme Court ruling after "[taking] one look at it."

There was no right to cross-examine during those hearings, and so forth."

Barr, moreover, predicted the U.S. Supreme Court will quickly grant an appeal and rule in Trump's favor.

I never thought a court would actually rule that someone who meets the requirements to become president would be blocked. This is really uncharted territory. And is this really the way Biden wants to get a second term. Bacsically appointed by courts.

One being Trump has never even been charged with an insurrection -- neither has ANYONE from Jan 6th as avatar_Shen Li  aptly pointed out. Further, he was acquitted of such a charge during his 2nd shame impeachment

I hesitate to make predictions because every time I think I've sussed the parameters of exactly how fucked up this country is now something happens to make me throw my hands up and adjust the markers outward again.

But if there's any sanity left at all this is what ought to happen:

The supreme court will agree to hear and expedite the case due to the serious and time-sensitive nature of the issue. It won't/shouldn't take them long to identify and highlight the Colorado decision's fatal flaws after which they will officially reverse the finding and clear the way for Don to participate fully in the Colorado primary.

Trump will be more popular and unbeatable than ever, democrats and their apologists will blame it on the "conservative court" and make a lot of noise about ways to "balance" the SC that have nothing to do with fixing anything but only packing the bench with more people "from their team", and independents will become even more disgusted with the whole Red/vs/Blue shitshow giving RFKJr and other non-duopoly candidates another polling bump.

Other states who are attempting or are considering their own Colorado-like shenanigans will likely drop those plans after a brief period of grasping for a different angle than the one that was just shot down.

Before long the whole litigating Donny off the ballot thing will fade into the background as other concerns take center stage again- those most likely being the continuing Palestine/Israel conflict (including escalating participation by other nations in the region), the increasingly obvious failure of the proxy war in Ukraine, and whatever China decides to do in response to the USA's provocations e.g. military entanglements with Taiwan.


Of course any or all of that could turn out to be absolute nonsense. The whole planet has lost what little mind it had left and almost nothing surprises me anymore.
