Prosecutors seek additional charge against Noor -  "intent to kill"



The Hennepin County Attorney's Office is asking the court to add another, more serious murder charge against the former Minneapolis police officer who shot and killed a Fulton-neighborhood woman while on duty in July 2017.



A motion filed Thursday asks Fourth District Judge Kathryn Quaintance to add a charge of second-degree murder against Mohamed Noor. At a September omnibus hearing, Quaintance ruled there was probable cause to charge Noor with third-degree murder and second-degree manslaughter in the death of Justine Damond, also known as Justine Ruszczyk.



Prosecutors say they are allowed to amend the charges against Noor prior to the start of the trial, currently scheduled for April 1. The motion notes that, with Quaintance's September ruling, "the court has already found probable cause for the first three elements of second degree murder," adding that a jury could find their case against Noor contains the fourth element: intent to kill.



County prosecutors argue that intent can be inferred from the circumstances of the shooting, which took place at night in a dark alley behind Damond's home.

The fiancé of Justine Ruszczyk Damond has spoken out against former police officer Mohamed Noor after the cop was found guilty of third-degree murder.



Don Damond told reporters on Tuesday that Justine's death exemplified a 'complete disregard for the sanctity of life.'



The Australian-American woman, 40, was gunned down outside her Minneapolis home after she called 911 to report a possible sexual assault behind her house in 2017.  



'Nearly two years ago my fiance, Justine Damond Ruszczyk, was shot dead in her pyjamas outside our home without warning as she walked up to a police car which she had summoned,' Mr Damond said.



'Ironically, the Minneapolis Police Department emblem on the squad door reads: "To protect with courage and to serve with compassion".



'Where were these values that night? That night there was a tragic lapse of care and complete disregard for the sanctity of life. The evidence in this case clearly showed an egregious failure of the Minneapolis Police Department.'    



Noor was charged with second-degree murder, third-degree murder, and second-degree manslaughter in the 2017 death of Damond, a dual citizen of the U.S. and Australia.[/quote]

It's rare for police officers to be convicted after asserting they fired in a life-or-death situation, but some Minnesota community members said they saw it coming for Noor because he is Somali American.



"Officer Noor was going to jail no matter what because he's a black man who shot a white woman in the state of Minnesota," said John Thompson, an activist and friend of Philando Castile, a black man who was killed in 2016 by a Latino suburban police officer who was acquitted.



Alana Ramadan, an African American and Muslim who held a sign calling for the resignation of Hennepin County's head prosecutor, said the African American people she's spoken with knew Noor would be convicted.



"It's almost like there's no hope," she said.



Hennepin County Attorney Mike Freeman dismissed the idea that race played a role in the case.



"That simply is not true," he said. "Race has never been a factor in any of my decisions and never will be. ... We look at each case based on the facts and the evidence and the law that's in front of us. And I will stand by what we have done."



When asked how Noor's case was different, Freeman, who has chosen not to charge some white officers in the past, said: "The evidence showed that the officer acted unreasonably."

You do not allow immigrants a licence to kill people. That is VERY VERY dumb.



Anyway, I'm glad he has been convicted for murder. She was a highly educated Veterinarian.
